This Privacy Policy describes how SThree Holdings LLC, doing business as SellSide ("SellSide," "we," "us," or "our"), collects, uses, shares, and protects your information when you use the SellSide platform at sellsideapp.com and any related services, tools, and features (collectively, the "Platform" or "Services").

1. What Information We Collect
1.1 Information You Provide
When you register for and use the Platform, you may provide us with:
- Account information: name, email address, username, password, phone number, business name, real estate license information (where provided), and role (agent, investor, wholesaler, broker, etc.).
- Billing information: payment information is collected and processed by our third-party payment processor, Whop. We do not store your full payment card numbers on our servers. We may receive limited billing-related data (such as subscription status, plan type, and the last four digits of your card) from Whop.
- Content and inputs you submit: property addresses, property details, photos, notes, comparable analyses, repair estimates, and any other data or materials you enter into the Platform's features, including the Comparable Analysis Module (CAM), Property Profile, Repair Cost Estimator, and AI-powered tools.
- Communications: information you provide when you contact us for support, provide feedback, respond to surveys, or otherwise communicate with us.
1.2 Information Collected Automatically
When you access or use the Platform, we (and our service providers) automatically collect:
- Device and technical information: IP address, browser type and version, operating system, device type, device identifiers, language preferences, and time zone.
- Usage information: pages viewed, features used, searches performed, property lookups, actions taken, timestamps, referring URLs, and error/crash data.
- Cookies and similar technologies: we use cookies, local storage, and similar technologies to keep you signed in, remember preferences, measure performance, and improve the Platform. You can control cookies through your browser settings, but some features may not work properly if you disable them.
1.3 Information From Third Parties
We may receive information about you or the properties you research from:
- Third-party data providers that the Platform integrates with, including RentCast, BatchData, and others we may add from time to time. This data typically relates to properties (ownership records, sales history, comparable sales, market data, repair and condition data), not to you personally.
- Payment processors (Whop) regarding your subscription status and transactions.
- Analytics and marketing providers regarding your use of the Platform.
- Single sign-on or social login providers, if we offer and you choose to use them (such as Google). In that case, we receive basic profile information (name, email, profile picture) as permitted by your settings with that provider.
1.4 Sensitive Information
We do not knowingly collect or process sensitive personal information (such as government IDs, health data, biometric data, precise geolocation, or race/ethnicity). Do not submit sensitive personal information to the Platform.
2. How We Use Your Information
We use your information to:
- Provide the Services — create and manage your account, authenticate logins, deliver features like CAM, Property Profile, and the Repair Cost Estimator, and process your property analyses.
- Process payments and manage subscriptions through Whop, including renewals, cancellations, and refunds.
- Communicate with you — respond to support requests, send service-related messages (billing, security, policy updates), and, with your consent where required, send product updates, tips, and marketing messages. You can opt out of marketing emails at any time.
- Improve the Platform — analyze usage, debug errors, develop new features, and evaluate the performance and accuracy of our tools, including AI-powered features. We may use de-identified and aggregated data from your use of the Platform for these purposes.
- Train and improve AI features using de-identified and/or aggregated data. We do not use your identifiable personal information to train third-party AI models without your consent.
- Prevent fraud and abuse — detect, investigate, and prevent fraudulent transactions, unauthorized access, violations of our Terms, and other harmful or unlawful activity.
- Comply with legal obligations — respond to lawful requests, enforce our Terms, and protect our legal rights and those of others.
- With your consent — for any other purpose disclosed to you at the time we collect the information.
3. Legal Bases for Processing (EEA / UK Users)
If you are located in the European Economic Area or United Kingdom, we process your personal information based on one or more of the following legal bases:
- Performance of a contract — to provide the Services you signed up for.
- Legitimate interests — to operate, secure, and improve the Platform, prevent fraud, and market our Services (where permitted).
- Consent — where required by law, such as for certain marketing communications or cookies.
- Legal obligation — to comply with laws that apply to us.
You may withdraw consent at any time where consent is the legal basis for processing.
4. When and With Whom We Share Your Information
We do not sell your personal information. We share information in these circumstances:
- Service providers and vendors who help us operate the Platform, such as Whop (payment processing and subscription management), hosting and infrastructure providers (such as Vercel and Supabase), email, SMS, and communication providers, analytics and monitoring providers, and customer support tools. These providers may access your information only to perform services for us and are contractually obligated to protect it.
- Third-party data providers we integrate with (such as RentCast and BatchData). When you use Platform features that query these providers, property and query information is sent to them. Your personal account information (such as your name or email) is generally not shared with them, but limited identifiers may be passed for authentication or usage tracking.
- AI service providers (such as Anthropic or OpenAI) when you use AI-powered features. Inputs you submit to these features may be processed by these providers under their terms, solely to generate the output you request.
- Legal, safety, and compliance — when required by law, subpoena, court order, or government request; to enforce our Terms; to protect the rights, safety, or property of SellSide, our users, or others; or to investigate fraud or security issues.
- Business transfers — in connection with a merger, acquisition, financing, reorganization, or sale of all or part of our business. We will notify you of any such transfer and any choices you may have regarding your information.
- With your consent or at your direction — for any other sharing we describe at the time of collection.
- Aggregated or de-identified data — we may share data that has been aggregated or de-identified so it can no longer reasonably be used to identify you.
5. Cookies and Tracking Technologies
We and our service providers use cookies and similar technologies to:
- Keep you signed in and remember your preferences.
- Measure how the Platform is used and improve performance.
- Detect and prevent fraud and abuse.
You can control cookies through your browser or device settings. Disabling cookies may affect how the Platform works.
Do Not Track. We do not currently respond to "Do Not Track" browser signals because there is no consistent industry standard for interpreting them.
6. How Long We Keep Your Information
We retain your personal information for as long as your account is active and for a reasonable period afterward to:
- Comply with legal, tax, accounting, and regulatory requirements.
- Resolve disputes and enforce our agreements.
- Maintain business records and backups.
When we no longer need your information, we will delete or de-identify it. De-identified and aggregated data may be retained indefinitely.
7. How We Protect Your Information
We use reasonable administrative, technical, and physical safeguards designed to protect your information, including encryption in transit, access controls, and monitoring. However, no system is 100% secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential and notifying us promptly of any suspected unauthorized access at info@sellsideapp.com.
8. Minors
The Platform is a business-to-business service intended for real estate professionals and is not directed to individuals under 18. We do not knowingly collect personal information from anyone under 18. If you believe we have collected information from a minor, contact us at info@sellsideapp.com and we will take appropriate steps to delete it.
9. Your Privacy Rights
Depending on where you live, you may have some or all of the following rights regarding your personal information:
- Access — request a copy of the personal information we hold about you.
- Correction — ask us to correct inaccurate or incomplete information.
- Deletion — ask us to delete your personal information, subject to certain legal exceptions.
- Portability — receive your personal information in a structured, machine-readable format.
- Opt-out — opt out of certain processing, including targeted advertising, sale or sharing of personal information, or certain profiling.
- Withdraw consent — where we rely on your consent, you may withdraw it at any time.
- Non-discrimination — you will not receive discriminatory treatment for exercising your rights.

If you use an authorized agent to submit a request, we may require proof of that authorization.
10. California Residents
If you are a California resident, the California Consumer Privacy Act (CCPA/CPRA) gives you specific rights regarding your personal information.
Categories of Personal Information We Collect
In the past 12 months, we have collected the following categories of personal information (as defined by the CCPA):
- Identifiers (name, email, username, IP address)
- Customer records (billing information, account details)
- Commercial information (subscription history, transaction data)
- Internet or network activity (usage logs, device data, interactions with the Platform)
- Geolocation data (approximate location derived from IP address; we do not collect precise geolocation)
- Professional or employment information (role, license information if provided)
- Inferences drawn from the above to create a profile of preferences and usage patterns.
We Do Not Sell Your Personal Information
We do not sell your personal information for money. We may "share" personal information (as defined under the CCPA) with analytics or advertising providers for cross-context behavioral advertising in ways that may be considered a "sale" or "share" under California law. You have the right to opt out.
Your California Rights
You have the right to:
- Know what personal information we collect, use, disclose, or share.
- Request deletion of your personal information.
- Request correction of inaccurate personal information.
- Opt out of the sale or sharing of your personal information.
- Limit the use of sensitive personal information (we do not use sensitive personal information for purposes that would require this right).

11. Virginia, Colorado, Connecticut, and Other State Residents
If you are a resident of Virginia, Colorado, Connecticut, Utah, Texas, or another U.S. state with comprehensive privacy legislation, you have rights similar to those described above, including the right to access, correct, delete, and obtain a portable copy of your personal information, and to opt out of targeted advertising, sale of personal data, or profiling that produces legal or similarly significant effects.
Please note: some of these state laws apply only to consumers acting in a personal or household context, not in a business or commercial context. Because the Platform is a B2B service used by real estate professionals in a commercial context, not all of these rights may apply to your use of the Platform. We will nonetheless make reasonable efforts to honor requests where practical.

To appeal a decision we make about your request, reply to our response email with "Privacy Appeal" in the subject line; we will respond within the timeframe required by applicable law. If we deny your appeal, you may contact your state Attorney General.
12. International Users and Data Transfers
The Platform is operated in the United States. If you access the Platform from outside the U.S., your information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those of your country. By using the Platform, you consent to this transfer.
13. Third-Party Links and Services
The Platform may contain links to third-party websites, services, or integrations (such as Whop, RentCast, and BatchData). This Privacy Policy does not apply to those third parties. We encourage you to review their privacy policies before providing information to them.
14. Updates to This Privacy Policy
We may update this Privacy Policy from time to time. The updated version will be indicated by a new "Last Updated" date above. For material changes, we will provide reasonable notice (for example, by email or an in-app notice) before the changes take effect. Your continued use of the Platform after the effective date constitutes your acceptance of the updated Privacy Policy.
